Terms of Use

Please read these terms carefully before using the HITA Indonesia Platform. Your continued use constitutes acceptance of these terms.

Summary

HITA Indonesia is a non-profit professional association for hotel IT professionals in Indonesia. Our Platform is for membership management and organizational communication. Be honest, respect others, keep your credentials safe, and use the Platform only for its intended purpose.

1. Acceptance of Terms

By accessing or using the HITA Indonesia Platform at https://hita-id.org (including all subpages and associated services, collectively the "Platform"), you agree to be legally bound by these Terms of Use and our Privacy Policy.

If you do not agree with these terms, please discontinue use of the Platform immediately. These terms constitute a legally binding agreement between you and HITA Indonesia (Hotel Information Technology Association Indonesia), a non-profit professional association established under Indonesian law.

2. Description of the Platform

HITA Indonesia provides a digital platform for its members and the public that includes:

  • Public informational pages (profile, chapters, partners, news & events, gallery)
  • A member registration system for hospitality IT professionals across Indonesia
  • An authenticated member portal for profile management and activity tracking
  • An administrative panel for HITA Indonesia administrators and editors

The Platform is provided "as is" for organizational and professional networking purposes. HITA Indonesia is a non-profit entity; the Platform does not facilitate commercial transactions.

3. Eligibility & Registration

Public Visitors

Any individual may browse the public areas of the Platform without registration. No personal data is required to access public content.

Membership Registration

Membership is open to professionals working in hotel and hospitality IT roles in Indonesia. By registering, you confirm that:

  • You are at least 18 years of age
  • All information you provide is accurate, current, and complete
  • You will maintain and promptly update your information when it changes
  • You are a current or recent professional in the hotel/hospitality technology sector in Indonesia

Google Sign-In

When authenticating via Google OAuth 2.0, you agree to Google's Terms of Service and acknowledge that HITA Indonesia will receive your basic profile information (name, email, profile photo) as described in our Privacy Policy.

4. User Conduct

You agree not to use the Platform to:

Provide false, misleading, or fraudulent information
Impersonate another person, member, or HITA Indonesia official
Attempt to gain unauthorized access to any part of the Platform or administrative systems
Upload or transmit malware, viruses, or malicious code
Scrape, copy, or redistribute Platform content without written permission
Engage in spam, unsolicited messaging, or harassment of other members
Violate any applicable Indonesian law, including UU ITE (Law No. 11/2008 as amended)
Use the Platform for commercial solicitation without HITA Indonesia's prior written consent

5. Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to:

  • Not share your password or session with any other person
  • Log out of the Platform on shared or public devices
  • Notify HITA Indonesia immediately at [email protected] if you suspect unauthorized access to your account

HITA Indonesia is not liable for losses arising from your failure to protect your account credentials.

6. Content & Intellectual Property

HITA Indonesia Content

All content on the Platform created by HITA Indonesia — including the HITA logo, name, design, articles, photos, videos, and organizational materials — is owned by HITA Indonesia or its licensors and protected under Indonesian intellectual property law. You may not reproduce, distribute, or modify this content without prior written permission.

Member-Submitted Content

By submitting any content (profile information, photos, comments) through the Platform, you grant HITA Indonesia a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating and promoting the Platform. You retain ownership of your content and represent that you have the right to submit it.

Third-Party Links

The Platform may contain links to external websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the privacy policy of every site you visit.

7. Administrator & Editorial Roles

HITA Indonesia grants specific administrators and editors elevated access to the administrative panel under a Role-Based Access Control (RBAC) system. Individuals granted such access agree to:

  • Use their access solely for legitimate HITA Indonesia organizational purposes
  • Maintain the confidentiality of member data they access in their role
  • Not export, copy, or share member data outside the Platform without authorization
  • Report any data incidents or security concerns to the Superadmin immediately

Misuse of administrative access may result in immediate termination of access and may be subject to disciplinary action under Indonesian law.

8. Suspension & Termination

HITA Indonesia reserves the right to suspend or terminate your access to the Platform, with or without notice, if you:

  • Violate any provision of these Terms of Use
  • Provide false information during registration
  • Engage in conduct harmful to other members or HITA Indonesia
  • Fail to renew or maintain valid membership status

You may request account deletion at any time by contacting [email protected]. Upon deletion, your personal data will be handled as described in our Privacy Policy.

9. Disclaimers & Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by Indonesian law, HITA Indonesia and its officers, members, and administrators shall not be liable for:

  • Any indirect, incidental, or consequential damages arising from your use of the Platform
  • Loss of data, access interruptions, or security breaches beyond our reasonable control
  • Content published by members or third parties on or linked from the Platform

HITA Indonesia's total liability to you for any claim arising from your use of the Platform shall not exceed IDR 1,000,000 (one million Indonesian Rupiah).

10. Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the Republic of Indonesia, including but not limited to:

  • UU No. 27/2022 — Personal Data Protection
  • UU No. 11/2008 as amended by UU No. 19/2016 — Electronic Information and Transactions (UU ITE)
  • UU No. 28/2014 — Copyright

Any dispute arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, the matter shall be submitted to the jurisdiction of the South Jakarta District Court (Pengadilan Negeri Jakarta Selatan) as the competent court of first instance.

11. Changes to These Terms

HITA Indonesia may modify these Terms of Use at any time. Material changes will be communicated via email or a notice on the Platform at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised terms. If you do not agree with the changes, you must stop using the Platform and may request account deletion.
